For the purposes of this Policy, CMC ICOS Biologics, Inc., dba AGC Biologics (“AGC Biologics US”) with registered office at 22021 20th Ave SE, Bothell, Washington 98021 acts as the data controller for the Personal Data that is collected via the Website. As a data controller, AGC Biologics US is responsible for ensuring that the processing of Personal Data complies with applicable data protection law, and specifically with the General Data Protection Regulation.

2. What Personal Data does AGC Biologics collect and why?


When a user completes an AGC Biologics contact form on the Website, the user will be required to provide certain Personal Data, including first and last name, email address, and phone number. AGC Biologics does not sell, rent or trade any of your Personal Data to third parties without your consent. Personal Data is not transferred to third parties unless provided for otherwise in this Policy. AGC Biologics may store information with a third party in encrypted form on secure servers.

Data Processors: We may engage third parties to process Personal Data for and on behalf of AGC Biologics. We require such data processors to process Personal Data and act strictly on our instructions and to take steps to ensure that Personal Data remains protected.

International Data Transfers: Your Personal Data may be transferred to, and processed in, countries other than the country in which you are resident. These countries may have data protection laws that are different to the laws of your country.

Specifically, our servers are located in the United States, and our group companies and third party service providers and partners operate in the US, Denmark, Germany and Japan. This means that when we collect your Personal Data, we may process it in any of these countries.

However, we have taken appropriate safeguards to require that your Personal Data will remain protected in accordance with this Policy. These include implementing an intra-group data transfer agreement (“Intra-Group Data Transfer Umbrella Agreement”) based on the European Commissions’s Standard Contractual Clauses for transfers of Personal Data between our group companies, which require all group companies to protect Personal Data they process from the European Economic Area or EEA, in accordance with European Union data protection law.

Our Intra-Group Data Transfer Umbrella Agreement can be provided on request. We have implemented similar appropriate safeguards with our third party services providers and partners.

Data Retention: We retain Personal Data we collect from you where we have an ongoing legitimate business need to do so (for example, to provide you with a service you have requested or to comply with applicable legal, tax or accounting requirements).

When we have no ongoing legitimate business need to process your Personal Data, we will either delete or anonymise it or, if this is not possible (for example, because your Personal Data has been stored in backup archives), then we will securely store your Personal Data and isolate it from any further processing until deletion is possible.

Withdrawing your consent will not affect the lawfulness of any processing we conducted prior to your withdrawal, nor will it affect processing of your Personal Data conducted in reliance on lawful processing grounds other than consent.


• You have the right to opt-out of marketing communications we send you at any time. You can exercise this right by clicking on the “unsubscribe” or “opt-out” link in the marketing e-mails we send you.
